The Delhi State Commissioner for Persons with Disabilities has ordered Uber India to compensate a traveller who was discriminated against for his disability.
In his order on November 5, Commissioner Thakur Datt Dhariyal set a three-month deadline for the cab aggregator to compensate Arman Ali an unspecified amount for causing mental and physical trauma besides 14,000 he lost on June 24 when he missed his flight to Bengaluru after a cab driver in Chennai cancelled the ride because of his wheelchair.
Two more Uber drivers cancelled his ride that day.
The order mentioned two sections of the Rights of Persons with Disabilities (RPD) Act, 2016, that prescribe fines of up to 5 lakh for causing trauma to a differently abled person.
A resident of Assam, Mr. Ali is the executive director of the National Centre for Promotion of Employment of Persons with Disabilities in Delhi.
He suffers from 80% locomotor disability.
The cab aggregator had offered to refund only the cancellation charge of 45, Mr. Dhariyal noted in his order while advising Uber India to introduce training modules for its employees and driver-partners on provisions of Rights of Persons with Disabilities (RPWD) Act.
The Commissioner for Persons with Disabilities for Delhi took cognisance of Mr. Alis complaint emailed on the day of the incident.
Stressing on the principles of dignity, non-discrimination, equality and accessibility enshrined under the United Nation Convention on the Rights of Persons with Disabilities, Mr. Dhariyal observed that it was the obligation of all service providers, public or private, to provide services according to the rules of accessibility as mandated by Section 46 of the RPWD Act.
Transportation has been specifically included as public facilities and services under Section 2(x) of this Act.
The Commissioner further recommended that the Ministry of Heavy Industries and Ministry of Road Transport and Highways frame a policy for manufacturing disabled-friendly cars and vehicles that can be used by people with disabilities.
