Emergency hearing held Saturday morning, judge extends time to comply until noon

WEST PALM BEACH, Fla. —

UPDATE- In an emergency court hearing Saturday morning, Judge Krista Marx denied Governor Rick Scott's motion for reconsideration in part and granted in part.

Judge Marx extended the 10 a.m deadline time to comply with the court order until noon, Saturday.

She ordered Palm Beach County Supervisor of Elections Susan Bucher that there be substantial compliance providing original and duplicate ballots that were reviewed by Bucher's staff.

Also, the deadline for county canvassing boards to file First Unofficial Results of General Election with the Department of State is noon, Saturday.

PREVIOUS STORY- West Palm Beach Circuit Court Judge Krista Marx has ruled in favor of Gov. Rick Scott and granted an injunction ordering Palm Beach County Supervisor of Elections Susan Bucher to submit “over-voted” and “under-voted” absentee ballots to the Palm Beach County Canvassing Board for an open and public review of each vote before they are counted.

This order is the result of the lawsuit filed by Scott late Thursday.

But late tonight, Palm Beach County Supervisor of Elections Susan Bucher announced that she is refusing to comply with a court order to submit over-votes and under-votes to the Palm Beach County Canvassing Board for review under the court-ordered deadline, according to Chris Hartline, Scott for Florida Spokesman.

She has not commented.

Broward County Circuit Judge Carol-Lisa Phillips, also ruled in favor of Governor Scott and ordered the immediate release of voter information from the county’s supervisor of elections.
